Limited Warranty

P&E Microcomputer Systems, Inc., (hereinafter called ‘PEmicro’), warrants this product to be free from defects in materials and workmanship under normal use for a period of one year from the date of purchase. This is a limited warranty which is valid only to the original purchaser of the product and is not transferable. The warranty period starts with the shipment of the hardware product.

PEmicro tests all hardware that is shipped to end users, resellers, and distributors. However, in rare cases the user may receive a piece of hardware that is not working right out of the box. This may be due to damage during shipping or storage. If the user notifies PEmicro of receiving non-functional hardware within 30 calendar days of purchase, PEmicro will exchange the defective unit with a new unit, or offer a refund, at PEmicro’s sole discretion.

Remedies under Limited Warranty

If a defect in materials or workmanship arises during the warranty period, PEmicro will, at its sole discretion:

1. Repair the product using new or refurbished parts;
2. Replace the product with a new or refurbished product;
3. Issue a refund for the purchase price of the product.

COVERAGE

To the extent permitted by applicable law, this warranty does not apply to:

1. Damage which results from accident, abuse, misuse, neglect, improper handling or improper installation
2. Damage or loss of the product caused by undue physical or electrical stress, including but not limited to moisture, corrosive environments, high voltage surges, shipping, or abnormal working conditions
3. Damage caused by operator error or non-compliance with instructions as set out in accompanying documentation, or operating the product outside the permitted or intended uses described by PEmicro
4. Unauthorized modifications or repairs; Products that have been serviced, altered, refurbished or modified by anyone who is not authorized by PEmicro
5. Normal wear and tear
6. Acts of nature (e.g., floods, earthquakes)
7. Failure to follow the product's user manual or guidelines
8. Products purchased from unauthorized sellers

Procedure for Obtaining Warranty Service

If the user purchased directly from PEmicro, they should please initiate an RMA request at PEmicro's website at the following link:

If the user purchased from a reseller or distributor, the user should please contact them to take advantage of this limited warranty.

Repair Service

For non-functional hardware which is not covered by warranty, PEmicro may repair damaged units for a repair fee at its sole discretion. Any and all returns must be previously authorized and include a clearly marked RMA number, which is obtainable through the PEmicro support system. Any items arriving at PEmicro's facility without an RMA number clearly marked will not be opened and will be returned or disposed of. The customer is responsible for shipping the damaged unit to the Company's designated service center. The customer will be provided with a cost estimate before any repair work commences.

Limitation of Liability

EXCEPT AS PROVIDED HEREIN, PEmicro MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PEmicro BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF USE, ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT.

Governing Law

This limited warranty shall be governed by the laws Massachusetts of the United States of America, as applicable.

Consumer Rights

By purchasing or using the Product, the customer acknowledges and agrees to the terms and conditions outlined in this warranty. The Company reserves the right to modify or update this warranty solely at PEmicro’s discretion.
